Latitude Announces New Updates to Support NYC LL97 Compliance and Embodied Carbon Regulations
- Affordable Housing Reinvestment Fund: Penalties collected from Article 320 buildings, amounting to up to 10% of a building’s carbon emissions cap, will be reinvested into affordable housing electrification projects, making sustainable energy more accessible.
● GHG Calculation Adjustments for Campus and Cogeneration Systems: Amends the methodology for greenhouse gas (GHG) emissions calculations to more accurately reflect the carbon footprints of campus and cogeneration systems, promoting fairer assessments.
● Emission Limit Adjustments: Provides detailed guidelines on how emissions limits adjustments can be granted, addressing legal, physical, or financial constraints that may hinder compliance.
● Filing Fees for Compliance Reports: Establishes a fee structure for compliance reporting and emissions adjustments, further clarifying the process for building owners.
2. Embodied Carbon Regulation Compliance: With the implementation of Executive Orders 22 and 23 at the state and city levels, capital project agencies and government projects are now subject to stringent embodied carbon guidelines. These directives ensure that new projects align with New York’s sustainability goals, placing particular focus on minimizing the carbon impact of construction materials and processes.
● NYC Executive Order 23: Directs city agencies to adopt sustainability measures, including embodied carbon requirements, for all capital projects.
